SPOUSAL SUPPORT & ALIMONY LAWS
IN WEST VIRGINIA
WHAT IS ALIMONY OR SPOUSAL SUPPORT?
Mostly referred to as, “spousal support” in West Virginia and many other states, alimony is payment made from one spouse to the other, usually after a divorce or separation. Spousal support is used to ensure that the recipient can avoid major financial hardship, and to keep an adequate lifestyle similar to what they were accustomed to. Generally speaking, payments are paid out from income, but in some circumstances, payments may be made from property or investments. No matter what, spousal support payments cannot exceed anyone’s ability to pay.
HOW IS SPOUSAL SUPPORT CALCULATED IN WEST VIRGINIA?
Spousal support is based on the needs of the recipient, as well as the financial resources of the payer. However, some circumstances do make the courts decide to change the amount awarded. For instance, if a marriage ended due to abuse, adultery, or the conviction of a crime, alimony is considered. For most situations, it is a case-by-case issue that courts decide upon after hearing all of the facts. There are many other factors involved in the amount of spousal support awarded, including, but not limited to:
THE DIVISION OF MARITAL PROPERTY
EACH SPOUSE’S AGE & MENTAL CONDITIONS
EDUCATION QUALIFICATIONS
TOTAL INCOME
LENGTH OF MARRIAGE & COHABITATION
MARITAL STANDARD OF LIVING
SACRIFICES/COMPROMISES MADE DURING MARRIAGE
(EDUCATION, EMPLOYMENT, ETC)
HEALTH CARE COSTS
