PENALTIES FOR DRINKING & DRIVING IN WEST VIRGINIA

It is illegal to drive a vehicle with a blood alcohol level, or BAC, of .08 or higher in the state of West Virginia. SECOND CONVICTION OF DUI: Six to 12 months in jail, a fine of $1,000 to $3,000, driver’s license suspension for one to ten years, mandatory interlock system, and the completion of a safety and treatment program before your license is reinstated.

THIRD CONVICTION OF DUI: One to three years in prison, a fine of $3,000 to $5,000, either a lifetime revocation of your driver’s license or a one-year suspension followed by an interlock device system and the completion of a safety and treatment program.
