PENALTIES FOR DRINKING & DRIVING IN WEST VIRGINIA

It is illegal to drive a vehicle with a blood alcohol level, or BAC, of .08 or higher in the state of West Virginia. The BAC limit for commercial drivers is .04, and .02 for any driver under the age of 21. This law also prohibits the use of narcotics, inhalants, and other intoxicants that alter the mind. THIRD CONVICTION OF DUI: One to three years in prison, a fine of $3,000 to $5,000, either a lifetime revocation of your driver’s license or a one-year suspension followed by an interlock device system and the completion of a safety and treatment program.
